General Conditions of Sale (GCS) – Rental of the Gîte “Au Lutin Pommé”

1. Identification of the Lessor

This seasonal rental contract is concluded between:

Jérôme Pochet and Sabrina Ducornet, co-hosts of the "Au Lutin Pommé" gîte, located at:

379, lieu-dit La Martais, 35420 Mellé

Hereinafter referred to as “the Lessor”.

2. Purpose of the Contract

These general terms and conditions of sale (GTC) govern the rental of the gîte "Au Lutin Pommé" by a tenant, hereinafter referred to as "the Tenant", for a short stay.

3. Reservation and Payment

Two booking options are available :

  • Flexible rate: possibility of cancellation with full refund up to 48 hours before arrival, the date of the request being the date of confirmation.
  • Reduced rate: no possibility of cancellation or refund.
  • Payment of 100% of the amount of the stay is required upon booking to block the chosen dates.
  • Accepted payment methods: bank transfer.
  • Written confirmation of the reservation will be sent after receipt of full payment.

4. Cancellation and Refund

  • Cancellation with the flexible rate: the Renter can cancel up to 48 hours before arrival to obtain a full refund.
  • Cancellation with reduced rate: no refund is possible.
  • Cancellation by the Lessor: In the event of exceptional circumstances preventing the Tenant from being accommodated (e.g. force majeure), the Lessor will offer either a postponement of the stay or a full refund.

5. Conditions of Occupation

  • The cottage is designed for 4 beds: 1 double bed and 1 bunk bed.
  • Sheets are not provided beyond the intended sleeping arrangements.
  • The Tenant undertakes to reArrival time: from 5 p.m.spect the premises and to return them in the condition in which they were found.
  • Arrival time: from 5 p.m.
  • Departure time: before 11 a.m.

6. Animals and Internal Regulations

  • The cottage is non-smoking.
  • Animals are not permitted, except with prior written permission from the Lessor.
  • The Tenant undertakes to respect the peace and quiet of the neighborhood and to avoid any excessive noise.

7. Liability and Insurance

  • No security deposit is required.
  • The Tenant is responsible for any damage that he may cause to the accommodation during his stay.
  • The Tenant is recommended to take out holiday insurance covering any damage.
  • The Lessor declines all responsibility in the event of theft or loss of the Tenant's personal belongings.​

8. Legal Status and Disputes

Since the Lessor is an individual, this rental is carried out as part of a seasonal rental between individuals. It is not subject to the rules of commercial law but falls under French civil law (articles 1713 et seq. of the Civil Code).

In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, the competent court will be that of the location of the accommodation.
